Terms of Use
These draft Terms of Use are intended to describe GTA Fire's role as a quote request and connection platform. They should be reviewed by an Ontario lawyer before relying on them.
Platform role
GTA Fire is a quote request and connection platform. GTA Fire does not perform fire protection inspection, testing, repair, certification, monitoring, engineering, field service, or code-compliance work. Work is performed by independent third-party providers.
No contractor relationship
Providers are independent businesses and are not employees, agents, partners, joint venturers, or representatives of GTA Fire. A customer's service contract, if any, is directly with the provider they choose to hire.
Customer responsibility
Customers are responsible for reviewing each provider's quote, qualifications, licence or certification status where applicable, insurance, scope of work, pricing, availability, and contract terms before hiring.
No guarantee
GTA Fire does not guarantee provider availability, response time, workmanship, pricing, results, code compliance, certification, inspection outcome, deficiency resolution, or service outcome.
Materials
For material sales requests, GTA Fire may connect customers with suppliers or providers. Customers and providers are responsible for confirming product suitability, code requirements, installation requirements, manufacturer instructions, warranties, and returns.
Limitation of liability
To the maximum extent permitted by law, GTA Fire's liability for any claim related to the website, quote request, referral, routing, introduction, or platform service is limited to the amount paid directly to GTA Fire by the claimant for the specific platform service giving rise to the claim, or CAD $100 if no amount was paid.
Excluded damages
To the maximum extent permitted by law, GTA Fire is not liable for indirect, incidental, special, consequential, punitive, business interruption, lost profit, lost revenue, property damage, compliance, regulatory, insurance, tenant, or operational losses arising from a provider's work, delay, failure, advice, quote, materials, or service.
No reliance on website content
Website content is general information only and is not legal, engineering, fire-code, insurance, safety, or professional advice. Customers should obtain advice from qualified professionals for their specific building and situation.
Governing law
These terms are intended to be governed by the laws of Ontario and applicable federal laws of Canada, with disputes heard in Ontario courts, subject to lawyer review and final drafting.
